The 9 Rights of Injured Workers in Georgia

State lawmakers have outlined these rights to ensure that injured workers are treated fairly and can obtain the benefits they deserve after an on-the-job injury. These rights are:

  1. You have the right to receive compensation for medical rehabilitation and income benefits if you are injured in a work-related accident. If you die in an accident at work, your survivors receive your benefits.
  2. You have the right to choose from a list of 6 doctors that your employer provides and change providers one time without informing your employer. Alternatively, if your employer offers a workers’ comp managed care organization, you may choose a provider through the organization. You also have the right to receive emergency medical care from any doctor.
  3. You have the right to compensation for your medical expenses, as well as some related expenses after you have been injured while working. These expenses may include medical bills, physical therapy, medication, and travel.
  4. You have the right to receive income benefits if your injury prevents you from working for more than 7 days. If you are unable to work for more than 21 days, the first 7 days will also be paid.
  5. You have the right to two-thirds of your average weekly wage, up to $525 per week, for 4000 weeks if you sustain a catastrophic injury on the job.
  6. You have the right to receive up to $350 a week for 350 weeks if you are unable to return to your normal work and are forced to take a lower-paying position.
  7. You have the right for your dependents to receive up to $7,500 in funeral expenses and two-thirds of your average weekly wage (up to $525), should you die in an on-the-job accident.
  8. You have the right to a late penalty payment if the insurance provider delays your payments unreasonably.

The 12 Responsibilities of Injured Workers in Georgia

You have certain responsibilities to your employer as a worker. These responsibilities are:

  1. You must follow written safety rules and other reasonable policies and procedure of your employer.
  2. You should report any accident to your employer immediately. You have 30 days to make a report to your employer, foreman, supervisor, or employer’s representative.
  3. You must accept reasonable medical treatment and rehabilitation service when ordered by the State Board of Workers’ Compensation.
  4. You will not receive compensation for an injury or death that occurs due to your own willful misconduct.
  5. You must notify your employer or their insurance carrier of a change in address, when you are able to return to full- or part-time work, and the amount of your weekly earnings to ensure you receive the appropriate benefits.
  6. Your dependent spouse must employ the insurance provider or employer of a change in address or remarriage, if they are receiving benefits after your death.
  7. You must attempt a job that is approved by the authorized treating physician, even if the pay is less than you earned before your injury.
  8. You have 1 year after the last authorized medical treatment or 2 years from the last benefit payment to file a claim for unpaid benefits that you believe you are entitled to.
  9. Your dependents have 1 year to file a claim for benefits if they do not receive allowable benefit payments after your death.
  10. You have 1 year from the date an expense was incurred to submit a claim for expenses related to your medical care for your injuries.
  11. You must submit to a drug or alcohol test after an on-the-job accident, or forfeit your rights to workers’ compensation benefits.
  12. You may be guilty of a misdemeanor and subject to up to $10,000 in fines and 12 months imprisonment if you are found to have made false or misleading statements while claiming benefits.
