Total vs. Partial Disability

When you are declared permanently disabled, your doctor will determine whether you have been totally or partially disabled. Total disability is when you lose the capacity to gainfully work all together, and you will never recover to the point where you will be able to do so again.

When you are partially disabled, you still have the ability to work, but in a limited capacity, and you will remain injured regardless of treatments or healing time for the foreseeable future.

Depending on which disability you are awarded, you could receive benefits amounting to a portion of your average weekly wages, or weekly payments for life at the state’s total disability rate in order to compensate you for the wages you have lost as a result of your injury.

Workers’ compensation can also provide you with benefits for:

  • Authorized medical treatments pertaining to the injury resulting in your disability
  • Reimbursement for travel to and from doctor visits for your injury
  • Assistance obtaining new employment and training if you cannot fulfill your old duty
  • Death benefits and funeral expenses should the injury cause you to pass away

Scheduled or Unscheduled Awards

If you are partially disabled, your condition may or may not fall into a disability schedule, depending on what part of your body is injured. For the most part, arms, ears, hands, feet, legs, and eyes are covered under these schedules, while head, spine, and organ injuries are not.

If your injury is scheduled, you can receive up to two-thirds of your weekly wages for a number of weeks determined by the schedule your injury falls under, up to a maximum of 160 weeks.

If your injury is unscheduled, then you can receive the same award for up to 300 weeks. However, for these injuries your award is reduced based on the percentage of disability your doctor awards you. For example, if your doctor declares you 50% disabled, you are eligible to receive up to 150 weeks of payments.

  • I called them and the next day they were at my house. (literally)

“I called them and the next day they were at my house. (literally) I have had lawyers in the past, (divorce, child support) not one was worthy. I was ripped off and used. I even got one disbarred. I was far from wanting to be used again by a Lawyer. I was extremely hesitant, guarded, apprehensive and skiddiest when it came to Lawyers. When they showed up at my place I was at ease, right off the bat. Craig is a tall man of strong structure, with a very strong southern accent. He spoke with confidence and reassurance with that southern draw. He reminded me as Atticus Finch from "To Kill a Mockingbird". As for Warlick he reminded me of the actor Mathew McConaughey from "A Time to Kill" Compassionate, and tenacious. I in fact told them how I felt about lawyers and they promised me they would stand by me. In fact they went beyond the call of duty! I hired them on the spot!”

  • They took their time and also were late on my weekly paycheck. The workman's comp people treated me like a second class citizen.

“I was injured on the job, and I don't know if you have ever dealt with workman's comp. Well I do, with out a Lawyer and with one. I started out without an Attorney, workman's comp gave me the run around. They took their time and also were late on my weekly paycheck. The workman's comp people treated me like a second class citizen. I finally got fed up with the running around done by workman's comp. I search for a Great Lawyers to help me out. Someone who cared about my situation and who had my back. I searched for awhile, some returned my calls and emails, others didn't at all. I was getting frustrated. Then I went to and found several Lawyers but the best reviews was Warlick and Craig.”
